Accused of swinging baseball bat at neighbour

A CLONDALKIN man has been accused of swinging a baseball bat at a neighbour in an incident on the street outside his home.

Val Hollowed, aged 62, lost his grip on the bat and hit a wall close to the alleged victim, it was alleged.

Judge Brian O’Shea remanded him on continuing bail at Blanchardstown District Court.

Mr Hollowed, with an address at Lindisfarne Grove, Clondalkin, is accused of producing a baseball bat in the course of a dispute, and assault at Lindisfarne Grove on October 8 last year.

The charges are contrary to Section 11 of the Firearms and Offensive Weapons Act and Section 2 of the Non Fatal Offences Against the Person Act.

Sergeant Maria Callaghan said the DPP directed summary disposal of the case in the district court subject to the judge considering the issue of jurisdiction.

Outlining the prosecution’s case, she said the alleged victim told gardai that following a dispute the accused had attacked him with a baseball bat. Gardai observed CCTV and saw the accused swinging a baseball bat and losing his grip and hitting a wall close to the alleged victim.

It did not connect, she said.

Judge O’Shea asked when the incident happened and the sergeant said it was on the public street outside “this gentleman’s address”.

The judge asked if there was some ongoing dispute involved and Sgt Callaghan said this was not stated in the summary of evidence she had.

Judge O’Shea accepted jurisdiction, allowing the case to remain in the district court and adjourned it to June 3. He granted free legal aid at the request of defence solicitor Valerie Buckley and ordered disclosure of prosecution documents to the defence.

The accused, who did not have to be present in court, has not yet indicated how he intends to plead to the charges.
