Man (32) accused of assaulting two Gardai

A TALLAGHT man has been accused of assaulting two gardai who allegedly fell and injured themselves as he tried to run from them.

Shane O’Malley was stopped for a search when he allegedly fled and violently resisted the gardai, Blanchardstown District Court was told.

Mr O’Malley, aged 32, with an address at Kilmartin Avenue, Tallaght, is charged with assaulting two gardai at Wheatfield Avenue in Clondalkin on September 19, 2020.

The DPP directed summary disposal of the case at district court level and Sergeant Maria Callaghan said there was a medical report available.

Outlining the state’s case, she told Judge David McHugh it was alleged that on the date in question, the gardai spoke to Mr O’Malley and said he would be searched under the Misuse of Drugs Act.

It was alleged he fled and was stopped a number of minutes later, when he violently resisted arrest and as he made efforts to get away, one garda fell causing bruising to her head.

The other garda also fell, Sgt Callaghan said. The prosecution was not alleging that the accused drew out and hit the gardai but the alleged assaults happened in an attempt to flee from them.

It was alleged Mr O’Malley caused them to fall and become injured, Sgt O’Callaghan said. Judge McHugh said he was satisfied to accept jurisdiction after hearing the outline of allegations.

He adjourned the case to February 4, 2021, for Mr O’Malley to decide how he intends to plead to the charges.
