ABP overturn council’s decision for 52 dwellings

AN Bord Pleanála has overturned South Dublin County Council’s decision to grant permission for the development of 52 dwellings on a site to the east of Bohernabreena Road and the south of Oldcourt Road in Bohernabreena.

Capami Ltd was granted planning permission for the development last January, comprising one three-storey, four-bed, detached house, one two-storey, three-bed, detached house, 32 two- and three-storey, three- and four-bed detached houses.

Provision of 18 one- and two-bed apartment units, to all be housed in one three-storey apartment block, was included in the application.

Bohernabreena residents David and Anne Kennedy lodged an appeal against South Dublin County Council’s decision last February.

The Kennedys outlined a variety of concerns in their grounds for appeal, including no work beginning on the construction of a main link road in the area which would service the proposed development, and they described the roads in the area as “rural roads with inadequate and unsafe pedestrian footpaths”.

They added that the rural nature of that portion of the Bohernabreena Road “is incapable of properly providing for pedestrians and cyclists” who want to access the subject site, and as such the development going ahead “would create significant health and safety concerns” for all of the road’s users.

ABP upheld the Kennedys’ appeal and refused permission for the development this month, stating that the proposed development “would not be developed at a sufficiently high density to provide for an acceptable efficiency in serviceable land usage”.

The appeals body concluded their refusal of permission by stating that the proposed development was “contrary to the proper planning and sustainable development of the area”.

In a separate planning application, Capami secured planning permission for the development of 24 dwellings on the Oldcourt Road in Firhouse from An Bord Pleanála earlier this year, after local residents lodged an unsuccessful appeal against the council’s decision to grant permission for the works in 2019.
