Council will carry out site inspection at freight company

SOUTH Dublin County Council are to carry out a site inspection of a freight company in Clondalkin early this month.
Enforcement notices to David Nestor Freight Services Ltd yard in Crag Avenue Business Park on October 9, requiring they cease a number of activities on site.

In August, The Echo reported how Ballymanaggin Lane residents have a complaint in with the council’s planning department, over the scale of activity beside their homes which they liken to a “port”.
Videos shared by residents revealed loud banging noises when containers are moved about, and clouds of dust sweeping over the cottages.
“Apart from the obvious holidays, it is business as usual,” said a Ballymanaggin resident.
“Digging machines are flattening the surface and adding hardcore to cover holes with water. Our guess is they will do drainage works as there are plenty of big pipes along the canal waiting. We have contacted the council but are waiting on real measures as there are hundreds of containers in the site and traffic as usual.”
Clondalkin Cllr Eoin Ó Broin (Ind) said: “To the naked eye it would appear that the order has not been complied with so I assume that the council will have to initiate legal proceedings.”
A council spokesperson said: “Two enforcement notices pursuant to Section 154 of the Planning and Development Acts, 2000 (as amended) were issued to the owner of lands at 12 Crag Avenue on October 9, 2020 requiring steps to be carried out within the period commencing October 14, 2020 and ending December 9, 2020.
“As the enforcement notice period has now expired, a site inspection will be conducted to report if the enforcement notices have been complied with. Failure to comply with the requirements of an enforcement notice may lead to the initiation of legal proceedings. It is proposed to carry out the site inspection early in the New Year.”
