Developer lodges appeal over €112,000 financial contribution at Colberts Fort

A DEVELOPER has lodged an appeal against South Dublin County Council’s requirement for them to pay a financial contribution of nearly €112k, in lieu of public open space, in relation to a residential development at Colberts Fort in Belgard, reports Aideen O’Flaherty.
Templemount was granted planning permission for the development, comprising a six-unit, three-storey apartment block and a two-storey house, last month.

The apartments are to consist of three two-bed units and three three-bed units, with external terraces/private gardens for each unit.
Provision of one end-of-terrace, two-bed, two-storey house is included in the plans.
South Dublin County Council granted permission for the plans on January 18, with a number of conditions.
These conditions include the requirement for car parking facilities for charging electric vehicles, and the stipulation that no dwelling unit can be occupied until all the services for each unit are complete and operational.
The council also required the developer to pay a financial contribution of €111,975 in lieu of the absence of the minimum required public open space for the development.
Templemount lodged an appeal with An Bord Pleanála this month against the financial contribution in lieu of public space aspect of the council’s grant of permission.
The appellant stated that the financial contribution “has been unfairly levied against the proposal and it will make the proposal unviable”.
They added a “large portion” of the site will be a new public realm area, including a new public road, footpath and cycle route, and they claimed that the local authority had previously deemed the amount of public open space provided for in the proposal as “acceptable”.
A decision on the appeal has not yet been made by An Bord Pleanála.
