Disgruntled taxi customer will have to pay €250 to charity to avoid conviction

A DISGRUNTLED taxi customer who called into Tallaght Garda Station will have to pay €250 to charity to avoid a conviction.

David McDonagh, aged 32, with an address at Killinarden Heights, Tallaght, had pleaded not guilty to breaching the peace and failing to comply with a garda’s directions at Tallaght Garda Station on June 2, 2017.

The case was before Judge Patricia McNamara for hearing.

McDonagh’s solicitor, Padraig O’Donovan, told Judge McNamara that his client was pleading guilty.

Sergeant Eithne Madden told the court that the failing-to-comply charge could be struck out.

She said that on June 2 last, McDonagh called into the public office of Tallaght Garda Station and started to become abusive to gardai.

Sgt Madden said McDonagh was disgruntled at the price of a taxi-fare that he had just been charged.

She said McDonagh had no previous convictions.

Mr O’Donovan said his client was the father of six children. He said the whole incident was that McDonagh had felt that he was overcharged for a taxi-fare.

Judge McNamara asked Mr O’Donovan why his client had taken a hearing date.

Mr O’Donovan said his client had wanted to prove his case.

Judge McNamara asked Mr O’Donovan if “drink was an issue” for his client. Mr O’Donovan said it wasn’t.

Judge McNamara said she would apply the Probation Act if McDonagh pays €250 to the Dublin Samaritans.

She remanded him to a date in November for payment of the donation.
