
Financial contribution of over €15k removed by ABP for charity WALK
Walkinstown Associa-tion for People with an Intellectual Disability Ltd (WALK) has won its appeal not to make financial contribution of €15,149.78 after been granted permission for a Day Service in Tallaght village, reports William O’Connor.
WALK was approved permission with conditions for the change of use of two existing ground-floor retail units at Coric House, Courthouse Square to a Day Service Centre.
The plans include new internal partitions to accommodate meeting rooms; open-plan learning spaces and toilet and staff facilities; external works comprise replacement of the existing shopfront at ground-floor level incorporating new windows, doors, fascia and signage.
However, South Dublin County Council in one of its conditions of approval said the ‘the developer shall pay to the Planning Authority a financial contribution of €15,149.78,”.
WALK made an appeal with An Bord Pleanála on the grounds that the group was a registered charity and that the site is located in the centre of Tallaght village where a 50 per cent reduction in contribution applies.
On making its decision, An Bord Pleanála said “The appeal submitted, states that the applicant, WALK is a registered charity and therefore is exempt from contributions,
“The Development Contribution Scheme, therefore, does not apply and the planning authority has not correctly applied the scheme.”
