Meter obstruction accused to seek High Court judicial review

THREE men accused of obstructing the installation of water meters in Rathfarnham are taking a judicial review to the High Court, Tallaght Court heard this week, reports Brendan Grehan.

Kareen Muhssin, aged 26, with an address at Llewellyn Close, Rathfarnham, Ferdia O’Brien, aged 23, with an address at St Patrick’s Cottages,Grange Road, Rathfarnham, and Sean Mcloughlin, aged 25 , with an address at Hillview Estate, Ballinteer, are all accused of obstruction at Dargle Valley, Rathfarnham, on April 15, 2015, contrary to Section 12(1) a and Section 8 (4) of the Water Services Act, 2007.

They were before Judge Patricia McNamara for a plea or date for hearing. Jurisdiction had previously been accepted in the case by Judge Bridget Reilly.

The court had heard it will be alleged that at 8.37am on April 15, 2015 gardaí received a call to go to Dargle Valley in Rathfarnham where water meters were being installed. McLoughlin, Muhssin and O’Brien were allegedly inside the area where the meters were being installed and told the gardaí they were protesting.

They were directed to move a number of times and were told they could protest on the other side of the barrier.

They allegedly failed to move and were arrested under the Water Services Act, 2007.

Muhssin’s counsel, Riannagh Morris BL, told Judge McNamara that her client was taking a judicial review in the case.

O’Brien and O’Loughlin’s counsel , George Burns Bl, said his clients were also taking a judicial review.

Judge McNamara adjourned the case to October for mention.
