Musician threw paving stone through window
A MUSICIAN who threw a paving stone through his neighbour’s front window, causing €250 damage, has been jailed for three months by Blanchardstown District Court.
Judge David McHugh had initially sentenced Aonghus McCann to 150 hours community service with three months jail in default.

He imposed the custodial sentence after he was told that McCann can’t do community service as he has a broken leg.
McCann, aged 43, with addresses at Westend Village, Blanchardstown, and Elmwood, Ballyroan, pleaded guilty to damaging a double-glazed pvc window at an address at Curragh Hall Crescent, Tyrellstown, on August 13, 2017.
He also pleaded gulty to public intoxication at Main Street, Blanchardstown, on August 30, 2017.
Presenting Sergeant Maria Callaghan told the court that at 11.10pm on August 30, 2017, McCann was on Main Street in Blanchardstown in a highly intoxicated state and was later arrested.
Sgt Callaghan added that on August 13, 2017, McCann was having a row with his neighbour in Curragh Hall Crescent in Tyrellstown. McCann then picked up a paving stone from the ground and threw it through his neighbour’s front window, Sgt Callaghan said. The bill for the repair of the window came to €250.
Sgt Callaghan said McCann has 125 previous convictions, mostly for public order offences and failing to appear.
McCann’s solicitor, Terry Hanahoe, said McCann works as a musician and has a broken leg.
Judge McHugh told Mr Hanahoe: “It’s wanton thuggery. We might have a row with our neighbours but this wouldn’t happen. It is quite shocking.”
Mr Hanahoe said McCann’s leg had been broken by his neighbour.
Judge McHugh said he would sentence McCann to 150 hours community service with three months jail in default. The Courts Probation Officer then went out with McCann to ascertain his suitability for community service.
30 minutes later the Probation Officer came back to the courtroom. He told Judge McHugh that McCann was unable to do community service as he had a broken leg.
He said one of McCann’s ankles was “fused”.
Sgt Callaghan asked if McCann could do static work.
Mr Hanahoe said he could not.
Judge McHugh said he would impose the default sentence of three months imprisonment.
He told Mr Hanahoe: “This is after careful consideration.”
