Petrol station lodge appeal against council’s decision to refuse extension

CIRCLE K has lodged an appeal against South Dublin County Council’s decision to refuse permission for an extension to their petrol station on Lucan Road in Palmerstown.
The plans for the single-storey extension included development of additional retail space and a fast-food unit, but the council refused permission last December, stating that the applicant “failed to provide sufficient justification” for the plans.

The local authority added that the additional retail element would have “a detrimental impact on the vitality and viability of nearby village and district centres in Palmerstown”, and “would be contrary to the proper planning and sustainable development of the area”.
Similarly, they also stated that sufficient justification for the fast-food element of the plans hadn’t been provided, “in terms of the potential impact on nearby vulnerable uses, neighbouring residents” and “the cumulative effect of an additional fast-food premises”.
Circle K lodged an appeal with An Bord Pleanála on January 26. They stated that the council had been “excessively cautious” in their decision to refuse planning permission.
The appellant said the justification for the proposed extension “relates to the need to modernise and upgrade the service station to meet market competition and customer expectation”.
They added that the petrol station is focused on “an entirely different retail market” to those of nearby retail centres, and is “almost entirely focused on capturing traffic from the R148 Chapelizod Bypass”.
In concluding their appeal, the appellant stated that it was their view that the council’s decision to refuse permission was “entirely unwarranted”.
A decision on the appeal has not yet been made by An Bord Pleanála.
