Uninsured driver off the road for four years

AN UNINSURED driver was put off the road for four years by Tallaght Court.

Judge Patricia McNamara also sentenced Shane Macken to 175 hours of community service.

Macken, age 23, of no fixed abode, pleaded guilty to having no insurance at Belgard Road, Tallaght, on November 15, 2017.

Macken’s counsel, David Condron Bl, asked Judge McNamara to put the case into the CCJ where Macken has matters awaiting a probation report.

Judge McNamara said she would prefer not to refer cases to the CCJ but to keep them in Tallaght.

Sergeant Michael Ahern told the court that at 2pm on November 13 last, Macken was stopped on the Belgard Road driving a Peugeot 206.

He said Macken was asked to produce his insurance certificate and he chose to produce it at Tallaght Garda Station but he never did.

Sgt Aherne said Macken has 61 previous convictions, of which 18 are for road traffic offences and two are for no insurance.

At District Court 8 in the CCJ on September 21, 2015, he had received a four-year ban for no insurance.

Mr Condron told Judge McNamara that his client is currently homeless.

He said Macken would be interested in working with the Restorative Justice Service and doing their drivers awareness course.

Judge McNamara sentenced Macken to 175 hours of community service in lieu of five months imprisonment and imposed a four-year driving ban. She also fined Macken €250.
