
‘Aggressive’ man produced an extendable baton to gardaí

A MAN, who produced an extendable baton when a garda would not tell him where his children were, was remanded for a probation report by Tallaght Court.
Sean Fitzgerald, aged 30, with addresses at Kilakee View, Firhouse, and Comeen, Ballydavid, Tralee, pleaded guilty to producing an extendable baton at Kilakee View on June 10, 2015.
Garda Chris O’Callaghan told Judge Patricia McNamara that on the above date gardaí had been called to Fitzgerald’s home as his wife had taken their children.
Garda O’Callaghan said that Fitzgerald’s wife had taken the children to a refuge.
Fitzgerald asked the gardaí where the children were and they wouldn’t tell him as the children were in a refuge.
Fitzgerald then produced an extendable baton and became very aggressive.
Garda O’Callaghan said Fitzgerald had eight previous convictions.
At Tralee District Court on December 4, 2013, he had received a four-year road ban for refusing to give a sample of blood or urine.
At Dingle District Court on March 28, 2008, he received a three-year ban for no insurance.
At Dingle Court on March 24, 2006, he received a €250 fine and a two-year ban for drunken driving.
Fitzgerald’s solicitor, Padraig O’Donovan, said his client had been upset as his partner had left with their kids.
He said his client would be willing to take part in the restorative justice programme.
Judge McNamara remanded Fitzgerald on continuing bail to a date in October for a restorative justice report and sentencing.
