Council request developer to pay €1m as part of planning condition

A DEVELOPER has been requested to pay a financial contribution to South Dublin County Council worth over €1million as one of 35 conditions outlined for the granting of permission for a residential development.

The demolition of three housing and nine farm structures for the development of 111 residential units at Tandy’s Lane in Lucan, which is part of the Adamstown SDZ, was recently given the green light.

A total of 111 residential units comprising of 69 houses, 18 apartments and 24 duplex apartments was permitted in a decision given by the council on August 12.

The duplexes and apartments will be accommodated in three four-storey blocks which will include balconies and terraces.

Originally lodged back in December 2020 by applicants Timothy and Henry Crowley, additional information in 12 different items of the application was requested by the council in February 2021.

The planning authority expressed concerns in relation to how the proposed development integrated into the phasing of the Adamstown SDZ (Strategic Development Zone).

Information was received majorly to the satisfaction of the council in May and later, it sought clarification around the location of the four-storey building along the east boundary of the site among other items.

After receiving all of the additional information, the planning authority deemed the proposal as “generally acceptable subject to conditions” – and listed out 35 conditions.

One of the standout conditions is listed as a financial contribution to the planning authority to the value of €1,108,070.52.

The developer is required to pay the contribution in “respect of public infrastructure and facilities benefitting development within the area of the planning authority, that is provided, or intended to be provided by or on behalf of the authority”.

The reasoning behind this was for the provision of facilities that will facilitate the development and considered it “reasonable that the payment of a contribution be required”.

Other conditions outlined are around noise pollution and working hours, archaeological reporting, notifying Western and Casement Aerodrome of crane erection, erection of a temporary fence, submission of a phasing schedule, redesigning and modification of certain aspects of the development and more.

Throughout the planning application, it is outlined how this Tandy’s Lane development is located within the St Helen’s Development Area of the Adamstown SDZ and in accordance with the Adamstown Planning Scheme 2014.

The Adamstown SDZ was first approved by An Bord Pleanála back in 2003 and through the councils policy surrounding Metropolitan Consolidation Towns, they believed that Lucan, including Adamstown, could expand to a population of up to 100,000.

Adamstown represents a key part of that expansion to the footprint of Lucan.
