Enforcement notice issued on local freight company

AN ENFORCEMENT notice issued to a freight company in Clondalkin requires they cease a number of activities on site, including the material change of use of the site to shipping container collection.
South Dublin County Council issued two enforcement notices to David Nestor Freight Services Ltd yard in Crag Avenue Business Park on October 9.

In August, The Echo reported how Ballymanaggin Lane residents lodged a complaint with the council’s planning department, over the scale of activity beside their homes which they liken to a “port.”
Videos shared by residents revealed loud banging noises when containers are moved about, and clouds of dust sweeping over the cottages.
Ballymanaggin residents told The Echo they are prepared to be patient with the process, but want to see a reduction of activity, and a reduction in the height of containers stacked up beside their homes, some of which have been stacked five high.
“We have to be patient, nothing has changed since August, but for the moment we are patient,” said Miguel Angel, a Ballymanaggin resident.
Another resident said they are disappointed there is nothing in the notice about a reduction of containers.
“The main thing is reduction. The last three to four years when they moved in, activity started getting busier, a few times we are woken up at 3 to 4am with deliveries, there is a lot of dust and noise. We have little privacy. It’s about getting back to what is was before,” he said.
Clondalkin Cllr Eoin Ó Broin (Ind) said he is “cautiously optimistic” about the process.
“I assume that Nestors will appeal the judgement but on the face of it it’s great that the council planning department have put the foot down or in this case ordered the containers to be dismounted.”
The Echo contacted David Nestor Freight Services for comment, but did not receive a reply at the time of going to print.
The enforcement notices requires the cease and discontinued use of a footpath along the western and southern boundaries of the lands, adjacent to the cottages, the cease and discontinued use of seven floodlights on site, and the use of a vehicle control structure at the western end of the site.
The notice period is from October 14 to December 9.
Council planners say failure to comply with the requirements may lead to the initiation of legal proceedings.
