An alleged punch from behind resulted in a hairline fractured jaw and facial damage

A MAN who allegedly punched another man from behind, leaving him with a fractured jaw and facial damage, could face trial in the Circuit Court.

Judge David McHugh in Blanchardstown District Court refused jurisdiction in Ciaran Maguire’s case.

Ciaran Maguire, aged 20, with an address at Lealand Road, Clondalkin, is charged with assaulting a named man causing him harm at the Roadstone Social Club, Kingswood Road, Clondalkin, on October 16, 2016.

Sergeant Geraldine McManigan told Judge David McHugh that the DPP had directed summary disposal.

Judge McHugh asked what was alleged.

Sgt McManigan said it will be alleged that at 1am on October 16, 2016, the injured party was leaving a birthday party with his girlfriend when he was struck from behind by Maguire.

She said it will be alleged that the injured party fell to the ground and this caused a hairline fracture to his jaw and the loss of three of his teeth.

Sgt McManigan produced a report from Maxillofacial oral surgeon on the injuries which Judge McHugh read.

Sgt McManigan said it was allegedly one punch and the injuries were caused when the injured party fell to the ground.

Judge McHugh refused jurisdiction.

He remanded Maguire on continuing bail to a date in September for the DPP response to his decision.
