A MAN who headbutted a garda has been sentenced to three months jail by Blanchardstown District Court.
The court heard that the gardai had been called to Alpine Heights in Clondalkin after Raymond McGarry assaulted his father.
McGarry, aged 36, with an address at Alpine Heights, Clondalkin, pleaded guilty to assaulting Garda Matthew Kelly causing him harm, three counts of assaulting Garda Kelly and one count of resisting arrest at Alpine Heights on February 8, 2018.
He also pleaded guilty to assaulting Fran McGarry at Alpine Heights on the above date.
Sergeant Piaras O’Sullivan told Judge David McHugh that on February 8 last, the gardai responded to a call to go to an address at Alpine Heights as Raymond McGarry had struck his father and knocked him to the ground.
Sgt O’Sullivan said McGarry headbutted Garda Matthew Kelly causing a fracture to his nose. He added that as Garda Kelly was attempting to handcuff McGarry, McGarry struck him to the side of his head with his elbow and McGarry also hit Garda Kelly on the shoulder with his foot.
Sgt O’Sullivan added that McGarry attempted to bite Garda Kelly and he resisted arrest.
He said McGarry had eight previous convictions including five for road traffic offences.
McGarry’s counsel, Ciaran McLoughlin Bl, said his client had a lot of alcohol consumed on the date in question.
Judge McHugh said: “I can see by his countenance. Is he a heavy drinker?”
Mr McLoughlin said McGarry was.
He said McGarry had his own business but had lost it as a result of his drinking.
Judge McHugh said it was a very serious incident where a garda had been assaulted.
He sentended McGarry to three months jail for the assault causing harm and took the remaining matters into consideration.
