Teenager accused of endangering the life of a cyclist while driving

A TEENAGER has been accused of endangering the life of a cyclist while driving dangerously at up to 120kph in west Dublin.

Mark Fagan is facing a circuit court trial on charges arising from the incident, after a judge refused jurisdiction to deal with the case at Blanchardstown District Court.

Mr Fagan, aged 19, with an address at Croftwood Green, Ballyfermot, is charged with several counts of dangerous driving as well as reckless endangerment on July 7 and 8, 2019.

Detective Garda John McWeeney said the DPP was directing summary disposal of the case in the district court subject to a judge accepting jurisdiction.

Outlining the prosecution’s case, he said an Almera was seen being driven at high speed on the Nangor Road, Clondalkin on the date in question.

It drove off through red lights at the Killeen Road junction and across the Luas tracks before almost colliding with a cyclist at Kylemore Avenue, Ballyfermot.

It was alleged the cyclist was put at “substantial risk of death,” Det Garda McWeeney said.

The Almera overtook two cars travelling in the same direction at Sarsfield Road and crossed to the wrong side of the road.

During the incident, the car was travelling at 100 to 120kph and the roads were extremely wet due to a heavy rainfall.

It also went the wrong way around roundabouts at Cherryorchard Avenue and Cedarbrook Way, Det Garda McWeeney continued.

After hearing the outline, Judge McHugh said he was refusing jurisdiction to deal with the case and adjourned it for the DPP.

Mr Fagan was remanded on continuing bail to appear in court again on a date in February 2021.
