Three months detention for Drimnagh teen who broke Luas passenger’s nose

A TEENAGER (19) who broke a Luas passenger’s nose was sentenced to three months detention by Blanchardstown Court.

Jordan Lee, aged 19, with an address at Slievenamon Road, Drimnagh, had pleaded guilty to assaulting a named male causing him harm on a Luas between Rialto and Suir Road on February 17, 2016.

The case was before Judge David McHugh for a probation report and to hear the facts.

Garda Aaron Moriarty told Judge McHugh that on February 17, 2016, he responded to a call about an assault on the Luas. He said he went to the Red Cow stop where they spoke with security who said that a man had been assaulted on the Luas.

The injured party had left the scene and was in transit to Tallaght Hospital. The injured party suffered a deep cut to the bridge of his nose and had got some cuts to his face.

Garda Moriarty said the injured party suffered a broken nose. He said he examined some CCTV from the Luas and later got on a Luas where he saw Lee.

He said Lee was smoking a cigarette and was asked by a passenger to stop. Garda Moriarty said Lee then lashed out at the passenger.

The second incident was not before the court.

He said he later arrested Lee on Parkgate Street. Garda Moriarty said the injured party had told him that during cold weather he has pain in the bridge of his nose.

Garda Moriarty said Lee had one previous conviction. 

At Dublin Circuit Court on December 5, 2016, he had been sentenced to six months, suspended for three years, for assault causing harm.

Lee’s solicitor said his client had a traumatic childhood.

He said Lee had been taken into care in 2010 and “had an extremely difficult childhood borne out of the chaotic lifestyle of his parents”.

He said Lee is now living with his grandfather in Drimnagh.

He added: “I think he is making progress”.

Judge McHugh said: “This is his second outing where he has gone out and assaulted a person”.

He said there was a balancing act between the defendant and the crime he committed.

He sentenced Lee to three months detention.
