Apartment dweller punched and kicked neighbour in row over noise placed on 12-month Probation Bond

AN APARTMENT dweller who punched and kicked his then neighbour in a row over noise was placed on a 12-month Probation Bond by Tallaght Court.

Karl Hiney also paid €500 compensation to the man he attacked, Damien Martin.

Hiney, aged 40, with an address at Loretto Avenue, Rathfarnham, had pleaded guilty to assaulting Mr Martin under Section 2 of the NonFatal offences against the person act at Mr Martin's address at Exchange Hall, Belgard Square, Tallaght, on January 24, 2017.

Hiney was living in Exchange Hall at the time.

The court heard that Hiney had made 50 complaints about noise coming from Damien Martin’s apartment and the defence had claimed that Mr Martin called Hiney “a mongo”.

The court had heard that on the evening of January 24, 2017, Hiney called to Mr Martin’s apartment and tried to barge past him into the hallway.

Mr Martin attempted to push Hiney out of the apartment but Hiney then punched him to the face. Mr Martin fell to the ground and Hiney kicked him on the ground.

Hiney’s defence lawyer, Padraig O’Donovan, said Hiney had the €500 in court. Judge Lindsay ordered that the €500 be paid to Mr Martin and he placed Hiney on a 12-month Probation Bond.
