A FATHER-of-one who refused to move on when found by gardai outside his ex-partner’s house became aggressive and told them: “I’ll get yous.”

Jason Byrne, aged 48,  had had a row with his ex before gardai arrived and told him to leave.

Judge Gerard Jones struck the case out, leaving him without a criminal record after he paid €150 to charity.

Mr Byrne, with an address at Earlsfort Avenue, Lucan, pleaded guilty to threatening, abusive and insulting behaviour and failing to comply with garda directions.

Blanchardstown District Court heard the incident happened at 8.30pm on August 30, 2020. Garda Sergeant Walter Sweeney told the court the accused was at Earlsfort Avenue when gardai directed him to leave the area.

The accused was outside his ex-partner’s house and refused to move on.

He became abusive and threatening to the gardai and said “I’ll get yous, you pricks,” Sgt Sweeney said.

Byrne had no previous convictions, was working as a security guard and had a certificate in this, the court heard.

On the night he was having a row with his ex-girlfriend and left eventually.

He said the incident was very out of character and he had never been in trouble before, his lawyer said.

Byrne apologised to the gardai and he was now living in a new house in Ballyfermot. His lawyer asked Judge Jones to be as lenient as he could in the circumstances.

The judge told the accused to make a €150 contribution to the Garda Benevolent Fund and said: “show me the cash.”

He left Byrne without a conviction after the payment was made.
