‘If you have been injured always seek legal advice’

PEOPLE who have suffered an injury or accident, should be aware of the time period Irish law considers for a personal injury claim, warns Citywest solicitor Mark Hyland.

Hyland says an “all too common” experience with clients is that they have not acted when they initially suffered an injury.

“They knew they were injured at the time of the incident but thought the injury would eventually heal and did not seek legal advice,” said Mark.

“The law in Ireland only allows an injured party to make their claim for personal injuries within a two-year period. After this you will be statute barred, and in most cases you cannot claim compensation for your injuries.”

Mark opened his own practice at Citywest Business Centre in January.

After qualifying as a solicitor in 2010, he spent the next eight years working for some of Dublin’s top solicitor firms – heading up the Personal Injuries and Litigation section of the last two firms he worked for.

“It was a great experience doing my traineeship in a general practice solicitors, it has given me the necessary exposure and experience to all the core law subjects.

“This experience was vital for me to open my own solicitor practice,” said Mark.

Through his work, he has seen personal injuries as a area of growth, but advises people to act quickly.

“It is important when an individual is injured in an accident to seek medical attention, a seemingly minor injury can manifest itself into something more significant over time.

“However, if the claim it is not put through the legal process within the two year period from the time the injury occurred, you may find your claim is ‘statute barred’ and you might not be able to recover compensation for the injuries you have sustained.
