Mr Canning, aged 39 with an address at Rowlagh Gardens, Clondalkin, is charged with assault causing harm to the woman on July 13, 2020.

Sergeant Maria Callaghan told Judge David McHugh the DPP consented to summary disposal of the case in the district court subject to the issue of jurisdiction being considered.

The alleged injured party had withdrawn her complaint but the DPP was proceeding with the charge, she said.

There was no medical report in relation to the injuries because the alleged victim refused access to it, the court heard.

Summarising the prosecution’s case, the sergeant said gardai responded to a call that a woman had been assaulted by her partner at Rowlagh Gardens on the date in question.

When they went to the scene, they observed she had injuries to her neck and there was blood coming from her mouth, it was alleged.

Judge McHugh accepted jurisdiction to deal with the case in the district court and adjourned it to April 15 for compliance with a disclosure order.
