Uninsured driver (30) jailed for four months

AN UNINSURED driver who was driving his partner’s car has been jailed for four months by Blanchardstown District Court.

Glen Russell was also banned from driving for five years.

Hearing that Russell had two previous convictions for no insurance, Judge David McHugh told Russell’s solicitor: “He is compos mentis in all respects”.

Presenting Sergeant Maria Callaghan told the court that on July 17 last, Garda Cian Logan stopped Russell in a car in the car park of the Mill Centre in Clondalkin as the car was displaying no valid tax or insurance.

Russell, she said told Garda Logan that he had a driving licence but he was arrested and taken to Clondalkin Garda Station.

Russell, aged 30, with an address at St John’s Crescent, Clondalkin, pleaded guilty to having no insurance and no driving licence at The Mill Centre, Ninth Lock Road in Clondalkin, on July 17, 2019.

Sgt Callaghan said Russell had two previous convictions for no insurance.

On September 11, 2018 at Dublin District Court, he had been fined €200 and received a four-year driving ban for no insurance. At Blanchardstown District Court on July 21, 2017, Russell had been fined €200 and was banned for two years for no insurance.

Russell’s solicitor said his client had gone to school in Ballyfermot and was now living with his partner and his stepson. He said Russell had bought a car for his partner and he recently had a vehicle stolen so he was moving his partner’s car when he was stopped. He asked the judge not to impose a custodial sentence.

Judge McHugh sentenced Russell to four months jail with a five-year driving ban.

Noting that it was Russell’s third conviction for no insurance, he told the solicitor: “He [Russell] is compos mentis in all respects”.
