Alleged unauthorised erection of mast subject of planning enforcement file

THE alleged unauthorised erection of a telecommunications mast at Sylvan Drive in Kingswood is currently the subject of a planning enforcement file, according to South Dublin County Council, reports Aideen O’Flaherty.

The council granted a license for the mast to Cignal Infrastructure Ltd last September, however this decision is under consideration by An Bord Pleanála, after local residents under the name of the Kingswood Heights Mast Opposition Committee lodged an appeal last December.

Fianna Fáil councillor Charlie O’Connor raised the issue at Monday’s monthly meeting of the Tallaght Area Committee, where he asked if a decision had been made in respect of the enforcement file.

In response, the local authority confirmed that an enforcement file had been opened “in relation to alleged unauthorised development occurring at Sylvan Road, Kingswood”.

They added: “The alleged unauthorised development consists of the erection of a mast without consent from [the] landowner.

“A warning letter [was] issued to Cignal Infrastructure Ltd and Jason Redmond & Associates dated December 11, 2020.

“The company/agent may make submissions or observations in writing to the Planning Authority regarding the alleged unauthorised development which, if true, would constitute an offence under the Planning & Development Acts, 2000 (as amended) not later than four weeks from the date of the service of the Warning Letter, i.e. January 12, 2021.

 “As the date for submission has expired, the file has been referred to our planning inspector for site inspection.  

“Should the Planning Authority, following site investigation, consider that unauthorised development has been carried out, it may decide to issue an Enforcement Notice under Section 154 of the Planning and Development Act 2000 (as amended).”
