Judge tells driver ‘his past is catching up with him’

A DRIVER with 11 previous convictions for no insurance has been jailed for three months by Blanchardstown District Court.

Jailing Dwayne Armstrong, Judge David McHugh said: “His past is catching up with him.”

Armstrong, aged 27, with an address at St Mark’s Avenue, Clondalkin, pleaded guilty to having no driving licence at St Mark’s Avenue on November 15, 2018.

He also pleaded guilty to having no insurance at Coldcut Road, Clondalkin, on April 11, 2018.

Garda Shane Harten told the court that on November 15 last, he observed Armstrong sitting in a white Volkswagen Golf with its engine running. He said that as he approached the car Armstrong got out of the driver’s seat and sat in the back. Garda Harten said Armstrong had no driving licence.

On April 11, 2018, Garda David Salmon said he stopped Armstong in a Ford Fiesta. The Garda said Armstrong had no insurance and later failed to produce his insurance certificate.

Garda Salmon said Armstrong had 75 previous convictions, 60 of which were for road traffic offences and 11 of which were for having no insurance.

Armstrong’s counsel, Ciaran MacLoughlin Bl, said his client was a father of one child.

He told Judge McHugh that Armstrong is “due to start a payroll course”.

Judge McHugh sentenced Armstong to three months imprisonment with a 10-year ban for having no insurance and fined him €500 for having no licence.
