Retention is refused for two storey duplexes at Parklands

RETENTION permission has been refused for two two-bed, two-storey duplexes at Parklands Parade is Saggart that were developed in lieu of a previously permitted creche and community facility.

Developer Greenacre Residential DAC received planning permission for the construction of 526 residential units adjacent to the Saggart Luas stop in 2018.

The grant of permission for that large-scale development included the construction of a creche and community facility, but Greenacre instead developed the two duplexes in its place.

The subject of the application for retention permission is two duplex units with associated private and communal amenity spaces, bin and bike store.

Greenacre Residential sought retention permission for the two units and all associated amendments to hard and soft landscaping and car parking on the adjoining street at Parklands Parade.

The applicant noted that the units were constructed in lieu of a previously permitted creche and community facility.

Instead, the applicant said the childcare and community facility needs of Cuil Duin and Parklands will be provided within a proposed creche and community centre at Cuil Duin Avenue.

On January 9, South Dublin County Council refused retention permission for the duplexes for a number of reasons.

“The subject application, if granted, would result in the non-provision of a crèche with community floorspace as required by Condition 2(a) under Planning Consent ABP300555-18 for which no suitable alternative provision would be made,” stated the council in its decision.

“Accordingly, the development would fail to comply with the requirements of Section 28 Ministerial Guidelines Childcare Facilities – Guidelines for Planning Authorities thus resulting in the under provision of childcare facilities for the development as consented.

“The development if retained would therefore be contrary to Childcare Facilities – Guidelines for Planning Authorities and the proper planning and sustainable development of the area.”
