The court had heard it will be alleged that Imgrat punched the injured party in the head while he was on the ground.

The injured party suffered a fractured eye-socket and a fracture below the nose, the court had heard. Imgrat and the injured party had been housemates at the time.

Imgrat, aged 43, with an address at Pinevalley Park, Rathfarnham, had pleaded not guity to assaulting Hugh O’Rahilly causing him harm at the above address on October 2, 2014.

The case was before Judge Coughlan for hearing. Imgrat was due to conduct his own defence as he has a legal qualification from Poland.

Judge Coughlan told the court: “I will reconsider jurisdiction. I’m entitled to do that.”

He looked at the medical report on the victim’s injuries, he said that the victim had sustained two facial injuries and had a long-standing medical condition.

He said: “I’m refusing jurisdiction. This is a very serious assault”.

He adjourned the case to November for service of the book of evidence.
