‘Jail is the only option’ for uninsured driver who also gets eight year road ban
AN UNINSURED driver was jailed for four months by Blanchardstown District Court.
Judge David McHugh also banned Raymond Malone from driving for eight years.
The court heard that Malone had moved from Tallaght to Portlaoise to stay out of trouble after he received a suspended sentence in Dublin Circuit Court for drug dealing.
Malone, aged 35, with an address at Laurel Drive, Esker Hill, Portlaoise, pleaded guilty to having no insurance and no driving licence at Milford Manor, Station Road, Clondalkin, on October 4, 2017.
Sergeant Geraldine McManigan told Judge McHugh that Malone was stopped at 3.05pm on October 4 last in Milford Manor in Clondalkin.
She said Malone was asked to choose a garda station where he would produce his driving licence and insurance within 10 days.
Malone chose Portlaoise but later failed to produce the documents.
Sgt McManigan said Malone had 20 previous convictions.
At Dublin Circuit Court on February 6, 2017, he had been sentenced to three and a half years jail suspended for four and a half years for possession of drugs for sale or supply.
At Tallaght Court on March 3, 2016, he had received a seven year ban for no insurance.
Malone’s counsel, Ciaran MacLoughlin Bl, said his client lives in Portlaoise and has been working for most of his adult life.
He said Malone works as a floor fitter.
Mr MacLoughlin said Malone is originally from Tallaght and he moved from Tallaght after he got the suspended sentence in the Circuit Court as he wanted to stay out of trouble.
Judge McHugh said he had considered the case.
He added: “Jail is the only option.”
He sentenced Malone to four months jail and imposed an eight-year disqualification.
